Draft Terms and Conditions for Use of the Asset and Liability Statement Template (Adopted from NAIC terms and conditions)
The Asset and Liability Statement template (“Template”) is the property of the Bermuda Monetary Authority (“BMA”). This Agreement outlines the specific terms under which the BMA grants users (“you”) access to the Template. By downloading or accessing any data from the Asset and Liability Statement, you agree to adhere to all the terms and conditions stated below without limitation or exception. By clicking the “Agree” button, you confirm that you have read, understood, and accepted the complete terms of this Agreement.
As the owner of all data contained within the Asset and Liability Statement, the BMA grants you a non-exclusive, non-transferable license to use this data only in accordance with these Terms and Conditions.
1. Permitted Use of the Data
- You agree to use the data solely for non‑commercial purposes.
- You may not market, sell, reproduce, or otherwise distribute the data in any format—electronic, printed, or via local or networked systems—without the BMA’s prior written authorization.
- You may not modify or remove any copyright, attribution, or proprietary notices associated with the data.
- You agree not to reverse engineer, disassemble, or decompile any application, system, or tool used to access or process the data.
- You acknowledge that unauthorized use, distribution, or modification of the Template, systems, or data may result in immediate termination of access and may also subject you to disciplinary or legal action.
- You expressly consent to the BMA monitoring your access and usage of the Template for administrative, compliance, and security purposes.
2. No Warranties
- THE BMA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE DATA, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
- The data provided in the Asset and Liability Statement is submitted to the BMA by reporting entities in accordance with specified content and security requirements. Each reporting entity is solely responsible for the accuracy, completeness, and compliance of its submitted information.
- All data is provided "AS IS." The BMA does not guarantee the truthfulness, accuracy, adequacy, or completeness of any information submitted, nor is the BMA responsible for any errors, omissions, or outcomes that may arise from the use of such data.
- You acknowledge that filings may be updated or amended by reporting entities, and the BMA is under no obligation to notify you of updates or provide revised filings.
- Furthermore, the BMA does not warrant that the systems supporting access to the Template or data will operate uninterrupted or error-free.
3. Limits on Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BMA DISCLAIMS ANY LIABILITY—WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE—for any direct, indirect, incidental, consequential, special, or exemplary damages arising from or connected to your access to, or use of, the Template or any associated data.
- This includes, but is not limited to, damages for loss of profits, business interruption, data loss, or financial losses resulting from reliance on the data.
4. General Provisions
- All downloads of the Template or related files are final. No refunds, replacements, or exchanges will be provided.
- This Agreement shall be governed by and interpreted in accordance with the laws of Bermuda, without regard to conflict of law principles.
- If any provision of this Agreement is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
- The BMA reserves the right to modify, update, or discontinue access to the Template or its components at any time without prior notice.
- The BMA may revise these Terms and Conditions at any time by posting the updated version. Continued access or use after such posting constitutes acceptance of the revised terms.
